Welcome to smokehbearsden.com (the “Site”), operated by SmokehBear's Den (“we,” “us,” or “our”). By accessing or using our Site or placing an order, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, please do not use our Site.
1. Overview
This Site offers apparel, accessories, and other print-on-demand merchandise created in partnership with Printify. All products are custom-made to order. By purchasing from us, you agree to these Terms, including our Refund and Return Policy, Privacy Policy, and any other policies referenced here.
2. Eligibility
You must be at least 18 years old or the age of majority in your jurisdiction to place an order on this Site. By placing an order, you represent that you meet this age requirement and have the legal capacity to enter into this agreement.
3. Products, Pricing, and Orders
All products are made to order using Printify’s print-on-demand service. Colors, sizes, and designs may vary slightly due to manufacturing and screen differences.
We reserve the right to refuse or cancel any order for any reason, including suspected fraud, errors in pricing, or production limitations.
Pricing is subject to change without notice. Taxes and shipping fees are calculated at checkout.
4. Payments
Payments are processed securely through Shopify Payments and other integrated gateways. You agree to provide current, complete, and accurate payment information. We are not responsible for any charges or fees imposed by your payment provider.
5. Shipping and Delivery
Estimated delivery times are provided by Printify and our shipping partners and are not guaranteed.
Risk of loss and title for products pass to you upon shipment.
We are not liable for delays caused by shipping carriers, customs (for international orders), or unforeseen events.
6. Returns, Refunds, and Cancellations
Please refer to our separate Refund and Return Policy. Because all items are custom-produced, we generally do not accept returns for change of mind, wrong size, or color selection.
7. Intellectual Property
All content on the Site (logos, graphics, designs, text) is the property of SmokehBear's Den or its licensors and protected by copyright and trademark laws.
You may not reproduce, distribute, or create derivative works from our content without written permission.
If you request a custom design, you warrant that you own the rights or have permission to use it, and you grant us a license to print and fulfill your order.
8. User Conduct and Prohibited Activities
You agree not to:
Use the Site for any unlawful purpose.
Submit or request designs that are infringing, offensive, defamatory, or violate third-party rights.
Attempt to interfere with the proper working of the Site.
We reserve the right to refuse service or cancel orders that violate these rules.
9. Disclaimers and Limitation of Liability
The Site and all products are provided “as is” and “as available” without any warranties.
We do not guarantee that product colors, sizes, or quality will match the display exactly.
To the fullest extent permitted by law, SmokehBear's Den shall not be liable for any indirect, incidental, special, or consequential damages.
Our total liability shall not exceed the amount you paid for the specific product in question.
10. Indemnification
You agree to indemnify and hold us harmless from any claims, losses, or damages arising from your violation of these Terms or your submitted designs.
11. Changes to Terms
We may update these Terms at any time. Continued use of the Site or placement of new orders after changes constitutes your acceptance of the updated Terms.
12. Governing Law
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the courts located in Duval, Florida.
13. Severability
If any provision of these Terms is found invalid, the remaining provisions will remain in full force and effect.
